Part 35 Compliant Expert Witness Services for Landscape and Garden Cost Disputes
We provide independent expert witness services for disputes concerning the cost, value, scope and standard of landscape and garden works. Reports are prepared for use in civil proceedings and in accordance with Civil Procedure Rules Part 35 and Practice Direction 35.
Our role is to assist the court or tribunal on matters within our expertise. In accordance with CPR Part 35, our overriding duty is to the court. That duty takes precedence over any obligation to the party or parties from whom instructions are received, or by whom we are paid.
Expert evidence is addressed only where it is reasonably required to resolve the issues in dispute. Matters considered may include quotations, contractual allowances, variations, completed works, remedial works, alleged overcharging, under-delivery, valuation of works and the reasonable cost of rectification.
Scope agreed at the outset
Instructions are considered by reference to the issues identified by the parties, any applicable court directions and the evidence available. The scope of any report can be agreed at the outset so that the opinion evidence remains proportionate, focused and relevant to the matters requiring determination. In most cases, once the proposed scope of work has been presented, we are able to provide a fixed fee for the work to be undertaken.
We may be instructed as a single joint expert or, where permitted, by an individual party. Our opinions are independent, objective and confined to matters within our expertise, and our reports can include the declarations, statements of truth and summaries required for Part 35 compliant expert evidence.
